The two are allowed, but the most important thing is to cut it, either by trimming or wiping it off completely. This sunnah  has got  great importance in ensuring a sound wellbeing, also while eating, it prevents us from  eating up the hair from the moustache with the meal. Other form of act of nature as taught by prophet Muhammad can picked from the hadith reported by Aisha(May Allah be pleased with her) : The Apostle of Allah (peace be upon him) said: “Ten are the acts according to fitrah (nature): clipping the moustache, letting the beard grow, using the tooth-stick, cutting the nails, washing the finger joints, plucking the hair under the arm-pits, shaving the pubes, and cleansing one's private parts (after easing or urinating) with water. The narrator said: I have forgotten the tenth, but it may have been rinsing the mouth.(Sunan Abu Dawwod hadith number 33)

Zaid bn Arqam also reported the prophet Muhammad (peace be upon him) saying,  Allah's Messenger (peace be upon him) said, "He who does not take something off his moustache is not one of us." Ahmad, Tirmidhi and Nasa'i transmitted it. Scholars have however advised that we should endeavor to carry out these acts of nature every week and at most every 4o days(Prophet Muhammad prescribed the 40 days himself as the highest days one could delay the fitrah).

The jurisprudence of joining ties of kinship (The Synopsis)
No religion, culture, ideology or doctrine does justice to this issue as islam.

One of the greatest mischief on earth is the breaking of the ties of kinship

People involved in great sins such as alcohol, fornication, polytheism, robber etc are in the same rank as he who breaks the ties of families described as great sins in islam.

Thus no one is exempted from this sin, what is required is ammendement, correction and self reformation

The jurisprudence of joining ties of kinship is described in islamic books under the following categories:

It’s negligence is grevious
Abu huraira related that the prophet said: all deeds of son of adam is shown on evening of thurs before friday, never will the deed of the breaker of ties of kinship be accepted.
Allah says: (and we shall turn to whatever deeds they did (in this life), and we shall make such deeds as floating dust scattered about.)

Comment: would nt each of us be cautious over our solat, fasting, hajj, enjoining good, forbidding evil, that our deeds would not be




As we know that joining ties is part of the jurisprudence of family while this is under the jurisprudence of mutual relationship and mutual relationship is a part of the general fiqh of islam, which is under the islamic laws while shariah is from islam an islam comes from allah.

Evidences from the qur’an

Q45: 18: then we put thee on the (right) way of religion: so follow thou that (way), and follow not the desires of those who know not.


This islam has its aims & objectives of islam for every individual:
For instance the sun, moon, wind, water, and the world, etc has the aims and objectives.
The same goes for the the established community and the family which is unit of a society.

Islam is aim at establishing a complete society;- faith, worship, moral, politics, economy, civilization, development, social development etc,
Mutually kindly to one another- wife/husband, father/child … mutually caring, this will breed love, love of goodness, devoid of mutual anger and hatred.

Q3: 103: and hold fast, all together, by the rope which allah (stretches out for you), and be not divided among yourselves; and remember with gratitude allah's favour on you; for ye were enemies and he joined your hearts in love, so that by his grace, ye became brethren; and ye were on the brink of the pit of fire, and he saved you from it. Thus doth allah make his signs clear to you: that ye may be guided.

Hadith: similitude of muslims in their mutual love, kind, care like a body when a part suffers it affects other parts in pain and vigil.

Society begins with the family as the smallest unit of the islamic society

Then the district, country, then the islamic society

Q4:1: o mankind! Reverence your guardian-lord, who created you from a single person, created, of like nature, his mate, and from them twain scattered (like seeds) countless men and women;- reverence allah, through whom ye demand your mutual (rights), and (reverence) the wombs (that bore you): for allah ever watches over you.
Q49:13: o mankind! We created you from a single (pair) of a male and a female, and made you into nations and tribes, that ye may know each other (not that ye may despise (each other). Verily the most honoured of you in the sight of allah is (he who is) the most righteous of you. And allah has full knowledge and is well acquainted (with all things).

Hadith: o mankind, your lord is one, your father is one verily the most honoured of you in the sight of allah is (he who is) the most righteous of you.


“those who fulfil the covenant of allah and fail not in their plighted word; those who join together those things which allah hath commanded to be joined, hold their lord in awe, and fear the terrible reckoning; those who patiently persevere, seeking the pleasure of their lord; establish regular prayers; spend, out of (the gifts) we have bestowed for their sustenance, secretly and openly; and turn off evil with good: for such there is the final attainment of the (eternal) home, gardens of perpetual bliss: they shall enter there, as well as the righteous among their fathers, their spouses, and their offspring: and angels shall enter unto them from every gate (with the salutation)
"peace unto you for that ye persevered in patience! Now how excellent is the final home!"

25- but those who break the covenant of allah, after having plighted their word thereto, and cut asunder those things which allah has commanded to be joined, and work mischief in the land;- on them is the curse; for them is the terrible home!
(curses of every cursers shall also be shared to them) (ra’d 20- 25)

Q52: 21: and those who believe and whose families follow them in faith,- to them shall we join their families: nor shall we deprive them (of the fruit) of aught of their works: (yet) is each individual in pledge for his deeds.



Meaning:
The word is used for all kinsmen, (lisanu arabiy) plural ar-haam.
1- also- forbidden for marriage among our kinsmen e.g aunt
2- also- one who is close to one from father and mother’s side, some could inherit or not,
3- families of one’s wife or one’s husband in judgement islamically.  Though mutual goodness to them is prescribed. This will increase affection/ love between the spouses.

Silah, wasl (joining)- opposite of forsakeness or desertation, i.e: doing good to families
Good words should be used, we should not take revenge
Show kindness, seek after them, even when they trample on your dignity, relate by evil with,

Breaking of ties is the opposite

Also goodness to kinsmen, connecting to them base on the condition of doer and the recipient, some require finances while others may require goodwill, visitation, salutation, concern, good look, advice, ward off evil, cheating, overlooking their mistakes etc,

SYNOPSIS: Asalam Aleikum, I am highly delightful to bring you another scintillating synopsis of the last Fiqh Forum. Ustaz Dhikrullah Shafii discussed the topic of shaving and pulling of the hair on the armpit with admirable passion as ever. Interestingly, other captivating issues were elucidated too. Kindly find the videos below.


He noted that there are two opinions on removing the hair of the armpit; he mentioned that all scholars believe that to pull it is the Sunnah and that it should not be left. You may also remember that the maximum time the pulling or the shaving could be delayed is forty days just like the pubic hair, while it is advisable to remove it every week (preferably Fridays).

 But the Scholastic adventure on this is if it should be shaved or pulled.  The collective opinion is that the pubic hair should be taken away by any means that pleases the person, since the aim is to get rid of the hair. Moreover, though pulling it is the Sunnah.


It is however advised that if powder or chemical is to be used, the victim should confirm and verify strictly from the medical experts that the powder or the chemical would not have defects on the skin. This also applies to other means that could be used to get rid of it.

Asalam Aleikum Warahmotullah, it is so delightful bringing you the synopsis of the last Fiqh Forum. Sheikh Dhikrullah Shafii discussed two great fascinating   topics, “Preparation for the month of Dhul Hijjah, and the Etiquette of ‘Eid”. Sheikh stressed the great opportunities we have as Muslims, stating that Allah has just blessed us with Ramadan and , another blessing has come to visit us , which is the blessings in the first ten days of dhul Hijjah. He shared the beautiful hadith below.

       Narrated by Ibn Abbas
    

      The Prophet said, "No good deeds done on other days
       are superior to those done on these (first ten days of
      Dhul Hijja)." Then some companions of the Prophet
       said, "Not even Jihad?" He replied, "Not even Jihad,
      except that of a man who does it by putting himself and
       his property in danger (for Allah's sake) and does not
       return with any of those things."  (Bukhari Vol. 2, Number 86)

He also discussed ‘Eid-ul- Adha with admiring passion, he noted that there are certain conditions that qualify one to slaughter ram. He mentioned that the person should be matured, mentally sound, must be able to afford it and he or she must be sincere.

Sheikh qualified his statement further that anyone who intends to slaughter ram should refrain from cutting his/her nails, and shaving of the pubic hair. He quoted the hadith below to qualify the statement.
     

         Narrated by Umm Salamah
        
           Allah's Messenger (peace be upon him) said: When any
       one of you intending to sacrifice the animal enters in
       the month (of Dhul-Hijjah) he should not get his hair or
       nails touched (cut). It was said to Sufyan that some of
       the (scholars) did not deem this hadith to be Marfu'. He
       said: But I deem it as Marfu' (i.e. chain of narration
       traceable right up to the Prophet).

In the name of Allah the Beneficent the Merciful, it is so delightful bringing you the synopsis of the last Fiqh Forum.  Ustaz Dhikrullah Shafii noted that the topic that has taken a pride of place has been  the Islamic Understanding of Peaceful Co-existence, this topic was necessary as a result of different uprisings in the world and violence in our local terrain . He noted however that the topic would be put to a halt for now, and  Islamic Understanding of Purification would be continued.

He drew a quick recapitulation on cogent points he had discussed. He re-emphasized the need for Muslims to take away the hair in the private part. He added that scholars have advised that for easy way out, it should be taken  away every Jumah, as part of  fitrah. Various means can be used eradicate the hair, like , razor. Modern substances like powder in taking away the hair is also allowed, in as much as it won’t cause harm to one’s health.

Meanwhile, prophet Muhammad (Peace be upon him) has placed a limit to the number of days we can delay the shaving of the pubic hair.  Anas bn Malik(May Allah be pleased with him) reported:
"The time period for us to trim the moustache, cut the nails, pluck out the underarm hairs and cut the pubic hairs was forty
nights." (Related by Ahmad, Abu Dawud and others).

As a sequel to earlier discussion, Ustaz Dhikrullah Shafii emphasized the need to honour every human being and all of its forms. He added that it  is also to be understood clearly that Allah created everyone from a single source(Soil), which passed through different stages,  Allah then invoked a spirit into it which became Prophet Adam(May Allah be pleased with him). For this reason and process, we are meant to respect every form of life, as no human being is different from another human being and we should always put away any form of arrogance to one another.  He noted also that Allah in His Majesty has  blessed the procreation of children of Adam right from their great father Adam and their great mother, Eve, in order to multiply from one generation to another.

Another proof to show that every human being is from a single source and why we should respect each other regardless of religion is the fact that we are all made from WATER, just as Allah informed us in Suratul Anbiyah Verse 30 “Have not those who disbelieve known that the heavens and the earth were joined together as one united piece, then We parted them? And We have made from water every living thing. Will they not then believe?”. 

Scientists have also confirmed this amazing verse with their research. This also points to the fact that one should not feel ostentatious to other human being, because there is no point for ostentation after all. Every human is created equal.
Allah has given us these qualities to make us distinctive from other creatures.

After  testifying to the Oneness of Allah and seeking blessings on the noblest of mankind, prophet Muhammad (S.A.W), his household, his companions and the generality of Muslims.
Ustaz Dhikrullah Shafii noted that it can be observed that for the past two months, the focus of Fiqh Forum’s lectures have centered on the  Islamic Understanding of peaceful Co-existence. He added that It is very important to treat this topic coherently due to what the Muslim nation is facing in the world today; we have been given horrendous appellations like terrorists, bombers, kidnappers, hijackers and other foolish names which are not part of Islam and in the dictionary of any serious Muslim.

Besides that, lots of obnoxious words are being uttered against the pristine cultures of Islam like wearing of Hijab, slaughtering of animals, mode of dressing in Islam and  Shari’ah as a whole. All these are increasing “Islamophobia” (fear of Islam), even Muslims today are scared of identifying themselves with Islam. It is therefore compulsory on us to clarify that Islam is not a religion of violence, and all the teachings it stands to represent are from Allah and are free from impurities or any act that could be disrespectful to human being.
Islam is a religion of peace, and it has come to re-install tranquility onto the surface of the earth, to call people to the worship One God (Allah) through peaceful and beautiful preaching ,to spread love and ensure equality among mankinds.
CAUSES OF VIOLENCE TAINTED WITH RELIGIOUS IMAGES
Scholars of Islam have identified that there are some people who claim to be Muslims, they pray like the Muslims do, they wear the same apparel as the Muslims, act like Muslims, some of them might even speak Arabic fluently, but their attitude is anti-Islam and a brutal dent to it, they practice Islam with ignorance and they portray the wrong perception of what Islam truly represents. They are the kind of people who kill and maim other people just because they are not Muslims. These set of people are causing more harm to the Muslim Nation than the  direct enemies of Islam, because their attitude is an embarrassment to Islam. . 
A similitude of these sets of depraved people in Nigeria is “Boko Haram”, the attitude of Boko Haram is UNISLAMIC and inhuman. Boko Haram constitutes an evil to the system of Islam and to the society at large, they kill innocent Non-Muslims, Muslims and even kill some Islamic religious scholars who do not support their ways. It is therefore important to understand  that Islam wants us to co-exist with people peacefully regardless of their religion. Many times, violence in a multi religious state, like Nigeria is often pointed to religion, but in the real sense, it is not.
Scholars are of the view that critical analysis into the root of these problem shows that it has social, economic and political undertone. They also even observed that wherever one finds a problem like this, there is always  a  of widespread social and economic injustice, and these kind of problem cannot be completely eradicated if there is no justice by the government.

We hereby advise the government that in proffering a permanent solution to the problem of Niger Delta and Boko Haram in Nigeria, the government must ensure justice first in the social and economic dealings. Also we advise that the government should dialog with these people9Niger Delat and Boko Haram) sincerely, with integration of religious and political experts, who would listen to these people and correct their stupid and horrendous acts.

Despite all these, it has also been observed that the actions of some non-Muslims could trigger the anger of Muslims, and sometimes, they get out of hands and eventually lead to violence: An example of this is jeopardizing or disrespecting the values of the Muslims,  in terms of creed or heritage. Like burning of the Quran, destruction of  mosques, slandering their prophet (Prophet Muhammad, peace be upon him), disrespecting their God (Allah), barring them from practicing their religion,  e.t.c. These are some of the things that can cause unending violence in a community. We thereby clarify further more that Islam is a tool that should be used to measure the Muslims and not vice-versa. If a Muslim does something wrong, that does not mean Islam instructed him to do so, and that does not also make every Muslim a trouble maker. We hereby  urge people to live peacefully with Muslims in peace too, so that we can achieve the peaceful co-existence.

In conclusion,We sincerely condemn all acts of bombing or devastation in the country, because through these stupid and inhuman act, innocent lives are being lost, Children become orphans, men and women become widowers and widows respectively, and lots of bread winners are being taken away in a devastating death.We pray Allah bring the perpetrators to justice, and may He unite us as one in Nigeria, we also pray Allah bring to reality the beauty of Unity in  diversity in Nigeria. We implore all  Muslims to remember that all human being is from a single parent ( Adam and Eve), Qurian  Chapter 4, and that everyone deserve to be respected even though we differ in religious standing.

Ustaz started by thanking Allah for the blessings He has given us as a Nigerian, he emphasized the blessings of balanced weather condition, abundant natural resources, blessings of intellectualism. He did not conclude until he appreciated the presence of people, stating that the increase in fuel price could have barred some people from making it to the venue of the lecture, but in return, people turned up in hordes. He conferred praises to Allah and sought for the blessings of Allah on the noblest of mankind, prophet Muhammad(Peace be upon him) and those who follow him till the day of judgement. He made a recap on the previous topics treated on Sunan Fitrah, he then proceeded to another act of nature, Shaving of the Pubic Hair. Kindly get comfortable with the synopsis in the next paragraph.
       Shaving of the pubic hair is often  viewed by some people on the tradition of custom, and who ever does it on the tradition of custom(without the sincerity of doing it for Allah)  would not have his reward. But if it is done because of Allah’s command then one would have the reward  .The technical meaning for pubic hair is similar to the linguistic meaning,  which is the hair that grows around and above the private part.

Evidence for shaving of pubic hair

 
In Qurian chapter 2 verse 124, Allah says “And remember that Abraham was tried by his Lord with certain commands which he fulfilled; He said: "I will make thee an Imam to the nations." He pleaded: "And  also (Imams) from my offspring!" He answered: "But my promise is not within the reach of evil-doers. The companion of prophet Muhammad (S.A.W), Abdullah bn Abbas(May Allah be pleased with him) further explained that the trial that Abraham passed through was the Sunnan Fitrah, which included shaving of the pubic hair. Moreover, for Prophet Abraham (May Allah be pleased with him) to have done it, then, it’s important on us to emulate him in that regard, as he is know as the father of worship. Abu Huraira on the other hand reported that “I heard the Prophet saying. "Five practices are characteristics of the fitra: circumcision, shaving the pubic hair, cutting the moustaches short, clipping the nails, and depilating the hair of the armpits."(Al-Bukhari, Volume 7, Number  779), the wife of prophet Muhammad(S.A.W) , Aisha(May Allah be pleased with her) also reported that The Messenger of Allah (peace be upon him) said: Ten are the acts according to fitrah: clipping the moustache, letting the beard grow, using the tooth-stick, snuffing up water in the nose, cutting the nails, washing the finger joints, plucking the hair under the armpits, shaving the pubes, and cleaning one's private parts with water. The narrator said: I have forgotten the tenth, but it may have been rinsing the mouth.(Muslim, hadith 119). In conclusion, following these acts of nature enables good state of wellbeing and internal tranquility. Ultimately too, it is one of the sunnah of prophet Muhammad(Peace be upon him) that is mandatory on us.

Islamic scholars have advised that shaving it on the day of Jumah would earn one  two rewards, the first is that one would be rewarded for doing sunan fitrah and also for doing the dedicated cleaning on the day of Jumah. Prophet Muhammad (Peace be upon him) says the shaving of pubic hair should not elapse forty days.

WAYS OR TOOLS FOR SHAVING THE PUBIC HAIR
There are different ways that one can employ, one can cut it away, by clipping or by applying  powder that can take the hair away. Scholars have advised us  to select any of the methods that is best suitable without medical implication.


Other condition is that one must be the one to carry out the cutting, except the legal partners like husband and wife that have been given the exception to assist each other in shaving it . It should be however be remembered that the cutting is  upward, the right part would be cut,  clip or powdered before the left, and it must be done in privacy. After the shaving has been accomplished, the hair should be buried, and this includes anything taking away from the human body such as nails e.t.c,  This can be found in Ibn Qudamo volume 1, page 86
       

ISLAMIC UNDERSTANDING ON PEACEFUL PROTEST

There are two opinions by scholar on the issue of protest,  a part says it is permissible with the condition that it is peaceful and free from any form of violence or abuse, and that, it is done with the sincere aim of putting things aright. Their argument goes as follows

Prophet Muhammad once said that we should assist our brother by correct him if he is the oppressor or he is being oppressed, and the companions asked how one could correct the one that is the oppressor, then prophet Muhammad said that you should stop him from oppressing people. The hadith related by Jabir Ibn Abdullah(May Allah be pleased with him) makes this more clearer, Jabir said
Two young men, one from the Muhajirs (emigrants) and the other one from the Ansar (helpers) fell into dispute and the Muhajir called his fellow
Muhajirs, and the Ansari (the helper) called the Ansar (for help). In the meanwhile, Allah's Apostle (peace be upon him) came there and said:
What is this, the proclamation of the days of Jahiliyyah (ignorance)? They said: Allah's Apostle (peace be upon him) there is nothing serious. The
two young men fell into dispute and the one struck at the back of the other. Thereupon he (the Prophet) said: Well, a person should help his
brother whether he is an oppressor or an oppressed. If he is the oppressor he should prevent him from doing it, for that is his help; and if he
is the oppressed he should be helped (against oppression).”(Sahih Muslim hadith 1181).

Also, Umar bn Khattab (May Allah be pleased with him) once asked the Muslims of what their reaction would look like if he(Umar ) transgresses.Then, a man sprang on his feet and said that he would correct Umar’s mistake with his matchet. Umar was so happy, he then praised Allah for blessing his Ummaah with a  man, who would correct Umar with a matchet  when he transgresses. All the companions present were silent (meaning: collectively agreed to the saying of Umar). These show that one can openly confront the leadership for correction when they are found transgressing.


Other scholars especially the Saudi Arabia scholars among others, are of the opinion that it is not permissible. Sheikh Abdul Azeez  bn Bass and sheikh Utheymin( May Allah be pleased with them) were of opinion that it is not permissible with coherent reasons, Sheikh Abdul Azeez stated that people could misuse the opportunity of the protest in perpetrating evils, like, destruction of property, violence and other vices,  he then  advised that other measures like advising and writing letter to the leader should be used instead(This can be found in his Fatawa).

Sheikh Utheymin also  added that modern trend has brought forth the term "protest", that it was not found among the earlier Muslims, he argued that it could lead to intermingling, uttering of abusive words and perpetrating different evils .He however mentioned that except it is a peaceful protest and organized within the moral of Islam , then it is permissible.

It is important to understand that the Scholars passing these Fatwa strictly considered there immediate environment. In Saudi Arabia for example, they have a good economic system for their citizens, so, protesting in such land could not be permissible as the scholars have rightly observed. But in a situation where there are issues that directly affect the Muslims like in the case of Palestine and other places where the Muslims are oppressed openly, it is mandated that there should be protest to stop oppression and liberate the Muslims from the shackle of oppression.

Sheikh Qardawi(May Allah be pleased with him),  emphasizes the need to engage in peaceful protest with the aim of eradicating oppression and upholding the teachings of Islam, he however made it coherent that the protest must be peaceful, free from abuse or any vices against humanity.

Having realized that the decision of scholars on this issue are based on the geographical area and the gravity of what calls for the protest, it is also a known fact that the early Muslims scholars were tortured and imprisoned as a result of their steadfast in confronting the transgressing leadership , one of the glaring example was the encounter of Hassan Albasori with Haja bn Yusuf Athaqofi. It can be drawn from their histories that scholars openly confront a transgressing leadership for correction, rather  watching gleeful. So peaceful protest in Nigeria is permissible, by strictly following the conditions identified by the scolars.

Ustaz Dhikrullah Shafii as ever, started by praising Allah and thanking Him for sparing our lives to witness the Muharram 1433H edition of the Fiqh Forum. He recapitulated the topic of  discuss; circumcision and moved to other part of “fitrah”(act of nature), cutting of the moustache. Ustaz also elucidated the world’s most disturbing topic,” Homosexuality and Gay Marriage In Nigeria” and why Islam forbids it and places death judgment on those who do it.

ISLAMIC UNDERSTANDING OF TRIMMING THE MOUSTACHE OR  CUTTING IT COMPLETELY
The two are allowed, but the most important thing is to cut it, either by trimming or wiping it off completely. This sunnah  has got  great importance in ensuring a sound wellbeing, also while eating, it prevents us from  eating up the hair from the moustache with the meal. Other form of act of nature as taught by prophet Muhammad can picked from the hadith reported by Aisha(May Allah be pleased with her) : The Apostle of Allah (peace be upon him) said: “Ten are the acts according to fitrah (nature): clipping the moustache, letting the beard grow, using the tooth-stick, cutting the nails, washing the finger joints, plucking the hair under the arm-pits, shaving the pubes, and cleansing one's private parts (after easing or urinating) with water. The narrator said: I have forgotten the tenth, but it may have been rinsing the mouth.(Sunan Abu Dawwod hadith number 33)


Zaid bn Arqam also reported the prophet Muhammad (peace be upon him) saying,  Allah's Messenger (peace be upon him) said, "He who does not take something off his moustache is not one of us." Ahmad, Tirmidhi and Nasa'i transmitted it. Scholars have however advised that we should endeavor to carry out these acts of nature every week and at most every 4o days(Prophet Muhammad prescribed the 40 days himself as the highest days one could delay the fitrah).

WHY ISLAM NEGATES HOMOSEXUALITY AND PLACES DEATH PUNISHMENT FOR IT
 It is so amazing and unthinkable that people could loose their senses below the mental degradation of animals, even animals don't practice gayism and lesbianism( Homosexuality). But it is so sad today that the enemies of the spirit of truth are coercing the Nigeria Senate to endorse the Gay Marriage  . Allah forbids it and places a death punishment for those who engage in such horrendous act.
Ustaz added that the issue of homosexuality was first practiced by the people of prophet Lut (peace be upon him), this triggered Allah's anger, after Allah had asked the prophet to leave the city with his sincere followers , the rest of the evil doers(those practicing homosexuality) were destroyed by the inversion of the earth. This was indeed a grave punishment on them, and this is where the Islamic scholars picked the punishment for the perpetrators of this act, by pushing from the top of  the tallest building in the community and immediately attacking them with stones as they reach the ground. This is a serious offence as it dishonours the dignity of procreation and continuity of life. It is a negation to the religious inclination of the Nigerians, It is a negation to the immune systems of the Nigerians and also a negation to Nigerian culture. He applauded Senate president for going against this with admirable courage and he implore all Nigerians to go against the act of gay marriage that can bring the wrath of Allah to our Nation.Continuation on this would be updated soon on this page.....please check back.

Are you going for Hajj or you have got someone preparing to go? or you hope to go someday?, then, the last edition of the Fiqh Forum is an importatnt one for you.As we all know that Hajj occurs in the 12th month of the Islamic lunar calendar, called Dhul-Hijjah, between the eighth and the 13th days of the month. Let us embark on this interllectual adventure with Sheikh Tirmidhi has he discussed the topic with beguiling passion.
He started by quoting the following verses of the Qurian which explain Hajj and Umrah with no equivocalness
Q2 VS 196
"Complete the Hajj (obligatory pilgrimage to Makkah) and the Umrah (optional visit to Makkah) for the sake of Allah. If you are prevented from proceeding then send such offering for sacrifice as you can afford and do not shave your head until the offerings have reached their destination. But if any of you is ill or has an ailment in his scalp which necessitates shaving, he must pay ransom either by fasting or feeding the poor or offering a sacrifice. If in peacetime anyone wants to take the advantage of performing Umrah and Hajj together, he should make an offering which he can afford; but if he lack the means, let him fast three days during the Hajj and seven days on his return making ten days in all. This order is for the one whose household is not in the precincts of the Sacred Mosque. Fear Allah and know that Allah is strict in retribution."

Hajj is in the well known months. He who undertakes to perform it must abstain from husband-wife relationship, obscene language, and wrangling during Hajj. Whatever good you do, Allah knows it. Take necessary provisions with you for the journey, and piety is the best provision of all. Fear Me, O people endowed with understanding."

The following points can be deduced from the verses above

1. The verses have called our attention on how to perform Hajj and Umrah

2. They also establish the importance of Hajj and that the rites of hajj and Umrah should be completely fulfilled.

3. The verses also tell us of the hindrances of Hajj with Islamic judgment on cutting our hairs and the rewards for those who do it. But has for females, Prophet Muhammad (S.A.W) enjoins them to take very little out of their hair, as they are not meant to completely wipe it away like the men.

Hajj and Umrah have indeed got overwhelming lessons for the Muslims, it instills faith in the hearts of the Muslims. Hajj gives the Muslims the opportunity to confirm his believes of Islam which in return increase his/her perspicacity on his ways of life which cuts across moral life, financial and political way of life e.t.c. It also creates tranquility in the minds of muslims from the point of having the intention of going to Hajj or Umrah, which installs sincerity, purity of the heart as the Muslims prepare to take mighty step closer to his GOD (Allah)
HOW TO PREPARE FOR HAJJ
SINCERE REPENTANCE
Hajj is a call from Allah to the Muslims, and anybody who wishes to answer this call should approach Him in a pure state by repenting sincerely of his/ her sins. If the sin is between him and Allah, he is meant to repent sincerely but if it is a sin between him and another human being, may be he has unjustly acquired another person’s property or taken the right of another person, then, such property and rights should be returned to the rightful owner. Also the traveller must do it to please Allah and not to show off opulence or to impress people.
PROPER DOCUMENTATION
The traveller must have a proper documentation of his belongings before embarking on the journey, also If the person holds some special post for an organization or company that requires his consultation when he leaves for Hajj, then he must do a proper hand over.
Also the traveller must leave his family in good condition, in terms of the financial strength and security.

CONDITIONS FOR HAJJ


One must be a Muslim
One Must be an Adult
One must be knowledgeable
One must be able to afford it
One ‘s security should be ensured during the travelling
Lawful companions for females


CONDITIONS IN THE FIRST TEN DAYS OF DHUL-HIJJAH(For those not in Hajj)


1.Praise Allaah regularly
2.Increase in good deeds
3.Remembrance of Allaah.
4.Fast in these days
5.Seclusion in mosque is recommended
6.Be tidy cut nails, hair etc. before Dhul-hijah

An accepted
Hajj denotes that:

  1. It must be paid for with legal earnings.
  2. One should keep away from evil, sin and unjust disputes during it.
  3. One should observe all its rituals according to the Sunnah.
  4. One should not show off by doing Hajj – it should be purely and done sincerely for the sake of Allaah.
  5. One should not follow it with acts of disobedience and sin.

  1. Abu Hurayrah, may Allaah be pleased with him, said: “I heard the Prophet sallallaahu 'alayhi wa sallam say: “Whoever does Hajj for the sake of Allaah and does not have sexual relations (with his wife), nor commits a sin or disputes unjustly during the Hajj, will come back (free from all sins) like the day his mother gave birth to him.” (Bukhaari & Muslim)
  2. Abu Hurayrah, may Allaah be pleased with him, also reported that the Prophet sallallaahu 'alayhi wa sallam said, “From one ‘Umrah to another is an expiation for the sins committed between them, and the accepted Hajj has no less a reward than Paradise.” (Bukhaari & Muslim)
  3. Aa’ishah, the Mother of the Believers, may Allaah be pleased with her, asked the Prophet sallallaahu 'alayhi wa sallam, “O Messenger of Allaah, can we not go out on campaigns and fight in Jihaad with you?” He said, “But the best and most beautiful of Jihaad is an accepted Hajj.” Aa’ishah, may Allaah be pleased with her, said, “I never stopped going for Hajj after I heard that from the Messenger of Allaah sallallaahu 'alayhi wa sallam.” (Bukhaari)
  4. Amr Ibn Al-‘Aas, may Allaah be pleased with him, reported that the Messenger of Allaah sallallaahu 'alayhi wa sallam said, “Hajj wipes out whatever (of sins) came before it.” (Muslim)
  5. Abdullaah Ibn Mas’ood, may Allaah be pleased with him, narrated that the Messenger of Allaah sallallaahu 'alayhi wa sallam said, “Keep on doing Hajj and ‘Umrah, for they eliminate poverty and sin just as the bellows eliminate impurities from iron, gold and silver.” (Tirmidhi & An-Nasaa’i)




THE RITES ARE AS FOLLOWS

Day of Arafat9th of Dhul-Hijjah
The Day of Arafat is considered one of the most important days, not just of Hajj, but of the Islamic calendar. Mount Arafat was the scene of the Prophet Muhammad's final sermon, and after making the 14.4km journey from Mina, pilgrims spend the day here in reverent prayer.
Elsewhere in the world, many Muslims choose to fast on this day.
After sunset, its time to move again, this time to Muzdalifah - a 9km trip - where they spend the night under the stars. Many will also begin collecting pebbles here for tomorrow's rites, departing again just before sunrise.
Eid day10th of Dhul-Hijjah
The 10th of Dhul-Hijjah is Eid al-Adha, a day celebrated by Muslims around the world as the greater of the two Muslim holidays.
For those performing Hajj, the day is know as Yamul Hajjil Akbar (The big Hajj day) and is probably the longest day of the pilgrimage, and the most dangerous.
Pilgrims start the day in Muzdalifah and begin heading back to Mina before dawn. Once in Mina, they perform the first Ramy, throwing seven pebbles at the largest of three columns known as Jamarat.
This act is a symoblic stoning of the devil, based on historic tradition. God told Abraham to sacrifice his son, the story goes, as proof of faith. It is believed that at this spot in Mina, the devil appeared and tried to dissuade Abraham from heeding the command. Abraham responded by throwing stones to scare him off.
Millions of pilgrims converge at the Jamarat bridge, which houses the three columns representing the devil, in order to re-enact the story.

Final days11th-13th of Dhul-Hijjah
With the hardest part behind them, pilgrims will now spend the next two or three days in Mina.
On each day, they will again symbolically stone the devil - this time throwing seven pebbles at each of the three pillars.
When their time in Mina is finished, pilgrims return to Mecca to perform the final circulation of the Kaaba, a "farewell" tawaf.
Before heading home, many also go to Medina, the second holiest city in Islam, where the Prpophet Muhammad is buried along with his closest companions. Visiting Medina, however, is not a part of Hajj.

Furthermore, there are many virtues of the rituals of Hajj and there is much wisdom to be found behind them. Whoever is blessed with proper understanding of them is blessed with much goodness. For example:
  1. When a person travels to perform the rites of Hajj, he is reminded of his journey to Allaah and the Hereafter. When he travels, he leaves behind his dear friends, wife, children and homeland, and the journey to the Hereafter is similar.
  2. The one who goes on this trip equips himself with enough provisions to help him reach the Sacred land, so let him remember that for his journey to his Lord, he needs to have sufficient provisions to help him get there safely, as well. Regarding this, Allaah says which means, “…And take provision, but indeed, the best provision is fear of Allaah…” (Al-Baqarah: 197)
  3. Traveling is a kind of torment and the same is true of the journey to the Hereafter, only (that it will be) much greater in scale. Ahead of man there is (the stage of) his passing away, death, the grave, the gathering, the accounting, the scales and As-Siraat (a bridge that will be laid across Hellfire, for people to pass over on the Day of Judgment), followed by either Paradise or Hell. The blessed one will be the one whom Allaah saves.
  4. When the pilgrim puts on the two garments of his Ihraam (the state of a pilgrim in which he performs Hajj and Umrah, and during which he is prohibited from certain acts that are lawful otherwise), he cannot help but be reminded of the shroud in which he will be wrapped (after he dies). This prompts him to give up disobedience and misdeeds. Just as he gives up his regular clothing (for Hajj), likewise he has to give up sins. Just as he has put on two clean, white garments, he has to make his heart clean and white (pure), and guard his senses, (so they remain) clean and pure, uncontaminated by the stains of sins and disobedience.
  5. When he says “Labbayk Allaahumma labbayk (Here I am at your service, O Allaah, here I am)” at the Meeqaat (station from where one enters into the state of Ihraam), he means that he has responded to his Lord; so how can he still insist on sinning and not respond to his Lord’s call to refrain from that? When he says “Labbayk Allaahumma labbayk”, he must (also) mean, “I am responding to Your prohibition of it (committing sins) and this is the time from which I am giving it up.”
  6. By ceasing to do Haraam (forbidden) things while in a state of Ihraam and keeping himself busy with the Talbiyah (a prayer recited by pilgrims going to Makkah) and Dhikr (remembrance of Allaah), the pilgrim gives himself a good idea about how a Muslim should be. In this way, he trains himself to give up some things which, in principle, are Halaal (allowed), but Allaah has forbidden them for him at this time (during his Ihraam); so, how can he violate the commands of Allaah and commit forbidden deeds, at all times and in all places?
  7. When he enters the Sacred House of Allaah, which He has made a sanctuary for mankind, he remembers the sanctuary of the Day of Resurrection, which no one can reach without striving hard and making a rigorous effort. The greatest thing, which will keep a person safe on the Day of Resurrection, is Tawheed (belief in the Oneness of Allaah) and shunning Shirk (association of others with Allaah). Concerning this, Allaah says which means, “They who believe and do not mix their belief with injustice – those will have security, and they are (rightly) guided.” (Al-An’aam: 82)
  8. Kissing the Black Stone which is amongst the first rituals to be carried out, teaches the visitor (of Allaah) to honor the Sunnah and not oppose the laws of Allaah with his feeble reasoning. He comes to recognize that there is wisdom and goodness behind the laws and rites which Allaah has prescribed for mankind, and trains himself to submit totally to his Lord. It is narrated that Umar, may Allaah be pleased with him, said after he kissed the Black Stone: “I know that you are only a stone and that you can neither benefit nor harm. If I had not seen the Prophet sallallaahu 'alayhi wa sallam kiss you, I would not have kissed you.” (Bukhaari & Muslim)
  9. When the pilgrim does Tawaaf, he is reminded of his father Ibraaheem, peace be upon him, who built the House so it would be a place of resort for mankind and a safe haven, and that he called them to perform pilgrimage to this House. Moreover, our Prophet Muhammad sallallaahu 'alayhi wa sallam also called humanity to perform pilgrimage to this House, to which Moosa, Yoonus and Eesaa, peace be upon them, also came for the same purpose. This House was a symbol and a meeting place for these Prophets; how could it be otherwise for Allaah had commanded Ibraaheem, peace be upon him, to build and venerate it?
  10. When he drinks the water of Zamzam, he is reminded of the blessing which Allaah has bestowed upon mankind in the form of this holy water, from which millions of people have drunk throughout history, yet, it has never dried up. He is encouraged to make Du’aa (supplications) when he drinks it, according to the Hadeeth in which the Prophet sallallaahu 'alayhi wa sallam is reported to have said, “The water of Zamzam is for whatever it is drunk for.” (Ibn Maajah & Ahmad)
  11. When he does the Sa’ie (running between Safa and Marwah), he is reminded of the trial that afflicted Haajar, the mother of Ismaa’eel and the wife of Al-Khaleel (i.e., Ibraaheem, peace be upon him); (he remembers) how she ran back and forth between Safa and Marwah, searching for water which would save her from what she was suffering, and especially so she could give her little son, Ismaa’eel, peace be upon him, water to drink. Since this woman was patient in the face of this adversity and turned to her Lord, this teaches the man that doing this is better and more appropriate. When a man remembers the struggle and patience of this woman, it makes it easier for him to bear his own problems and a woman, who is of the same gender (as Haajar), will also find her problems easier to put up with.
  12. The standing in Arafah reminds the pilgrim of the throngs of people on the Day of Gathering. If the pilgrim is tired due to being in a crowd of thousands, how will it be to stand amongst the hordes of barefoot, naked, uncircumcised people, for fifty thousand years?
  13. When he throws the pebbles at the Jamaraat (the three small stone-built pillars in Mina), the Muslim trains himself to obey Allaah unquestioningly, even if he does not understand the reason and wisdom behind this act, and cannot make the connection between rulings and their purpose; this is a manifestation of complete submission to Allaah.
  14. When he slaughters his sacrificial animal, he is reminded of the great incident when our father Ibraaheem submitted to the command of Allaah to sacrifice his only son Ismaa’eel, peace be upon them, after he had grown up and become a helping hand for him. He is also reminded that there is no room for sentiments, which go against the commands of Allaah. This teaches him to respond to what Allaah orders, as Allaah tells us that Ismaa’eel, peace be upon him, said: “…‘O my father, do as you are commanded. You will find me, if Allaah wills, of the steadfast.’” (As-Saaffaat: 102)
  15. Once the pilgrim comes out of the state of Ihraam that he was in and things that had been forbidden to him become permissible again, he is thus taught about the consequences of patience and that after hardship comes ease. The one who responds to the call of Allaah will have joy and happiness, and this delight cannot be felt by anyone except those who have tasted the sweetness of obedience, such as the joy felt by one who fasts upon breaking his fast or by the one who prays during the last part of the night, after he has finished praying.
  16. After he concludes performing all the rituals of Hajj as they were prescribed by Allaah and in the manner that He loves, the pilgrim has hope that his Lord will forgive all his sins, as the Prophet sallallaahu 'alayhi wa sallam promised in the Hadeeth: “Whoever does Hajj for the sake of Allaah and does not have sexual relations (with his wife), nor commits a sin or disputes unjustly during the Hajj, will come back (free from all sins) like the day his mother gave birth to him.” (Bukhaari & Muslim) This encourages him to start a new page in his life, free of evil deeds.
  17. When he comes back to his wife and children, and experiences the joy of meeting them again, this reminds him of the greater joy of meeting them in Paradise. This also teaches him that the greatest loss is losing one’s self and family on the Day of Resurrection, as Allaah says which means, “…’Indeed, the losers are the ones who will lose themselves and their families on the Day of Resurrection. Unquestionably, that is the manifest loss!’” (Az-Zumar: 15)

Alhamduilah, we thank Allah for making us complete theRamadan, we pray Allah accepts it as an act of Ibaadah(worship). This is thefirst Fiqh Forum we have had after Ramadan. Writing out a synopsis on this was delayed as I found myself in an evaluating episode concerning where to begin.Ride on with me as Ustaz Dhikrullah Shaffiy began by recapitulating previouslectures on circumcision. It was indeed an interesting session with him.
According to previous lectures, we have established that circumcisingin a balanced way (tradition of the prophetMuhammad ,Peace be upon him) has numerous advantages. One of them is that itprevents the collection of germs on the male organ, it prevents collection ofurine on unwanted places in the outer part of the male organ, and it increasesthe organism during sexual intercourse (with lawful partner). Circumcision alsoplays an important role in the life of the females. It prevents cancer of thegenital, it enables the females to control her sexual urge and thus respect herchastity, it also increases the enjoyment during sex with her partner (Lawfulone).
Having recapped the past lectures, Ustaz Dhikrullah Shaffihemphasized the importance of understanding the profession of circumcision andits gravities. Islam is strict on how Muslims get the sources of their income,because Allah says that He is pure and he would not accept anything from manexcept that which is pure.
Basically Islam permits us to take some aspect of human lifeas profession, like one can take bathing and wrapping of the dead as aprofession, but it rejects praying on the dead as a profession, building thecorpses as a profession or taking brick laying on the grave of the deceased asa profession. Moreover, taking circumcision as a profession is legitimate in Islam.The circumcised pays to the circumciser, in a situation where the circumcisedis young, the father or the heir of the family can pay on behalf of thecircumcised.
ISLAMIC POSITIONS ON THE PUNISHMENT ON A MISTAKE ON CIRCUMCISION OR ANY OTHER PROFESSION THAT INVOLVES HUMAN LIFE ON THELINE
Islamic position on this is that if an expert or aprofessional who have delivered excellently overtime makes a mistake on his/herprofession and it does not lead to death, then, such people would not be heldresponsible for the consequencies. Contrary to this is if a quack doctor or aquack "professional" makes a mistake that does not involve loss life, then he/sheshall be held responsible for the consequences of the mistake.
Another category of the position is that if a persondeliberately kills another soul,then the murderer would be killed too. But if a professional or an expert doesmake a mistake that led to loss of life, then he/she would pay a blood moneyequivalent to N22,000,000 (Twenty Two million Naira, the equivalent in Nigeriamoney) and would then fast for 60 days without a break(as in day(s)). And for the case of afemale professional who made such mistake and received her monthly period during the fasting,she would pulse when she sees her period and continues later after completingit.
This rules cut across every profession that involves humanlife on the line, i.e Medical doctor Doctor, Nursing, Public transport drivers,Motorcycle drivers e.t.c.

Also in the case of a quack circumciser, who made a mistakedue to his/her incompetence, that caused a permanent damage, the damagewould be measured and a fraction of the blood money would be payed to thecircumcised, this could be two third or the equivalent fraction.

ISLAMIC POSITION ON HOLDING A BANQUET FOR A CIRCUMCISEDCHILD.
It is permissible to call for banquet if the circumcision ishealed on the organ, Some of the scholars are of the opinion that weshould celebrate the healing of circumcision of the males and silent the females, while some are of theopinion that banquet should be called for the two sexes after the circumcisionis healed, these can be found in the opinions of Imam Ahmad, Imam Shaffiyy andIman Abu Hanifah and their students (May Allah bless the all).
Imanm Ambali (Rohimullah), established that we can call abanquet for anything that triggers ones happiness and the evidence is from thehadith of prophet Muhammad(Peace be upon him) by Abdulilah Ibn Umar( May allahbe pleased with him and his father) that prophet Muhammad ( S.A.W) said that ifany of your brothers calls you to a celebration(involving food/ banquet), youshould honour it(answer him and celebrate with him). One could call for banquet on a completion of the recitation ofthe whole Qurian, Academic graduation, opening of new houses or anything thatinvolves happiness.

THE WELCOMING OF RAMADAN AND UNDERSTANDING OF ITS PREPARATION

The last edition of the Fiqh Forum would remain in the consciousness of those who attended it for a very long time. It was indeed a test of faith as there was an unprecedented torrential rain, yet people displayed high level of commitment.
For the first time, the lecture started late , Ustaz Dhikrullah Shaffi placed himself in the audience shoes as ever and discussed the topic with admirable enthusiasm. Now I feel highly ecstatic to bring you the textual synopsis.

WELCOMING THE MONTH RAMADAN
Prophet Muhammad (S.A.W) used to chant this prayer in Rajab(7th Islamic month) “Oh Allah Bless us in the month of Rajab and Shaban and make us witness Ramadan". This was the tradition of the prophet, the scholars of Islam have explained the lessons of this tradition, they elucidated that the prayer is to sensitize the companions on the coming of Ramadan and also to establish the essence of prayer in Islam, meaning that supplication is a weapon to attack any problem, and this gives the companions the glad tidings on how to prepare for Ramadan morally, intellectually, socially e.t.c. The prophet would also address them to prepare for its activities,he used to add that a great month would come to you in which the gates of paradise are opened and the gates of hell fire are closed, taught them how to observe voluntary payers, remembering of Allah,he would also tell them that there is a night of majesty in it, in which any act of worship exercised on that night is better tthan the worship done in a thousand months.
UNIQUE BLESSINGS OF RAMADAN AND THE PECULIARITY OF THE UMMAH OF PROPHET MUHAMMAD(MUSLIM NATION)
Jabir bn Abdullah(may Allah be pleased with him and his father) said that prophet Muhammad(S.A.W) said Allah has blessed my Ummah(The Muslims) with FIVE things that can’t be found in the UMMAH of other prophets . He said the first is that Allah turns His face of mercies towards the Muslims when Ramadan is approaching, and who so ever this face of mercies has been turned towards would never experience His torture nor punishment . Secondly, the odour that comes out of the mouth of a fasting Muslim is beloved to Allah than the fragrance of Al-misk, thirdly Allah would command His angels to seek forgiveness for the fasting Muslims of their sins e.g (lieing, fornication,taking of alcohol,abortion,adultery,forgery e.t.c),the angels would continue to seek Allah’s forgiveness for the fasting Muslims .Fouthly, Allah would command the heaven to prepare the best adornment for the fasting Muslims. And the fifth is that on the last night of the month of Ramadan Allah would command that the sins of the fasting Muslims be forgiven , one of the companions asked the messenger if it was the night of the majesty that the forgiveness would occur, prophet said NO, that the night of majesty has its own separate rewards, that the forgiveness he is talking about is for everybody who has fasted in the month of Ramadan, which comes up at the last night of Ramadan.

PREPARATION FOR RAMADAN
The prophet used to prepare for Ramadan meticulously, he used to fast in Shaban to prepare his body for the rituals of Ramadan, the wife of prophet(Aisha, May Allah be pleased with her) said that the prophet never fasted for the whole month except in Ramadan and that he never fasted severally except in Sha’ban. And he used to wake up at night for prayers to get his body accustomed to it and also to make the mind be prepared for Ramadan. Muslims are then warned to be adequately prepared for Ramadan, because failure of preparation might not make them attain the maximum benefits. Muslims are also to beware of deviating from the teachings of the month of Ramadan, because deliberate deviation would make those who do that to be spiritually blind whereby they won’t recognize the truth from the evil. One is expected to be submissive sincerely to the teachings in Ramadan so as to avoid being the victim of disobedience.


It is also important to establish that Ramadan is anInstitution of learning to reform the Muslims, it is meant to instill the fearof Allah in us, Ramadan is meant to make us to be fulfilled with what Allah hasgiven us(be it small or big), Ramadan also comes to teach us to follow thePrescriptions of Allah and the Sunnah of Prophet Muhammad, thirdly Ramadan hascome to teach us how to have absolute reliance in Allah, and lastly Ramadan hascome to teach us how to prepare for the last day and the great journey back toAllah.
1.THE PREPARATION OF THE HEART

In preparing for Ramadan, the preparation of the mind is ofgreat importance, the prophet Muhammad once said that if the heart is pure thewhole body would be pure, and if the heart is impure the whole body would beimpure (i.e in the state of calamity),he also said the fear of Allah ishere(he gesticulated beating his heart).




2. THE PHYSICAL PREPARATION (MEDICAL PREPARATION)

The state of wellbeing is also important in preparing for Ramadan,Muslims are meant to consult doctors to ensure that they are physically soundbefore Ramadan, in fact, if it requires that there is need for one to take some rest to acquire enough energyfor Ramadan, one must do it.




3 FINANCIAL PREPARATIONS

The means of livelihood must be pure; Allah does not accept anythingexcept that which is pure. The source of income must be Halal(pure or allowed),this would enable smooth relationship with Allah and make one a pious believer.



4. INTERLLECTUAL PREPARATIONS

Muslims are meant to learn about the dos and don’ts ofRamadan, we must take time to consult knowledgeable people to learn about therules of fasting, the allowed and the dis-allowed.




5. EMOTIONAL PREPARATION
We must be emotionally prepared, our neighbors, colleaguesand environment must perceive it in us, we must be nice and joyous to peopleand make them feel the coming of Ramadan.
6. ORGANISATIONAL PREPARATION

Different organizations must be prepared on what to offer its followers andthe generality of Muslims, this also includes individual preparation , familypreparations e.t.c, there must beRamadan Worship(Ibaadah) roster which would detail the number of lectures that would be held accordingly with time and venues, how Tarawih would be planned to suit the Sunnah,the number of Nawaafil that would be done , the number ofQurian that would be recited e.t.c. Also the family should prepare a roster ofthe kinds of food to eat. This is important as it stabilizes our consciousness for Ramadan.

May Allah spare our lives to witness more of this on the surface of the earth, Amin.

WHAT WE SHOULD UNDERSTAND
Salam Aleikum, We thank Allah for making the last Fiqh Forum a success, and we seek His blessings on the seal of all prophets-Muhammad (S.A.W).
Again, I am highly ecstatic to bring you the synopsis of the last fiqh Forum with the title :Continuation of Islamic Culture on Circumcision.



As ever, Sheikh Dhikrullah Shaffii, placed himself in the audience shoes to elucidate the topic with admirable enthusiasm.

He emphasized that all the schools of thoughts in Islam opine that circumcision is an essential part of Islam. But then, it is important to understand that there are some conditions or exceptional cases whereby circumcision might be avoided. For example in a situation where the flesh to be cut off is absent in the private part, in this case circumcision is no more mandatory or in a situation whereby a child was begotten without sufficient energy to undergo an operation. Another example is the avoidance of circumcision for an aged person that accepts Islam,this is necessary as it might be too demanding for him/her to undergo the surgery, due to fear of death. This was also pointed to the time of prophet where an aged fellow accepted Islam and was scared to undergo the minor operation(circumcision) being one of the essential parts of Islam, then, prophet excused him from being circumcised due to the pain and fear of death but only asked him to cut off his hair. Also in Islam, it is not allowed to circumcise the dead,In addition, circumcision is avoided for a baby that is begotten with an ailment on the genital part or a child begotten premature, also if there is an envision after diagnosis of a child that there could be unstopped flowing of blood or other medical problem that might not be controlled after the operation, it is mandatory to AVOID circumcision. These are the conditions that could make us avoid circumcision.

UNDERSTANDING ISLAMIC CULTURE ON CIRCUMCISION AND THE THREAT OF UNITED NATION ON FEMALE CIRCUMCISION

Even after it has been proven medically that circumcision reduces the risk of genital cancer . The UN has repeatedly opposes the circumcision of the females, due to the damage caused to the females victim by amateur operators and diluted orientation.

But Interestingly, Islam is a balanced religion; it would never go beyond Allah’s prescription nor hover on its laxity. Moreover, in as much as circumcision is a prescription of Allah, Muslim would always carry out the operation properly so as not to create an horrendous scenario to the victims as stated at the beginning.

HISTORICAL BACKGROUND OF THE BATTLE AGAINST FEMALE CIRCUMCISION BY THE UN

Unfortunately today, this diluted ideology by the UN is growing stronger all over the world. It is also very disturbing today that some insincere Islamic scholars are also obsessed with the UN diluted ideology. It is important to understand that circumcision in Islam is a jurisprudence issue.

The war against female circumcision was not leveled on the Muslims abruptly because they fear it might be too rigid on them,so they employed the gradual eradication methods. These are the stages that were adopted.

The fight against female circumcision was first established in one of the UN conferences in GENEVA in 1931 on Children Positions in Africa, when one of the participants made a submission on the eradication of female circumcision, this was objected as it was not the topic of discussion but a digression, but it was published in the communique by Europeans which was immediately objected by non-Europeans. Though there were objections but that was the starting point of the battle.

This opened an atmosphere of discussions on eradication of female circumcision. Conferences began to be erected all over the world especially in Africa, and the minds of the women were poisoned against female circumcision. This led to different protests of women against female circumcision in Africa.

This was how eradication of female circumcision began to gain the center of discussion in Africa. A conference was held in Togo in 1964, in which it was recognized that female circumcision has has medical defects. In 1976 the eradication of Egyptian and Sudanese ways of carrying out the operation was established.

Unfortunately in 1998 it was strictly established by the UN that female circumcision should be completely eradicated and should not be taught in the medical schools, and all countries are mandated to adopt it too.
This has remained with us till date. But every Muslim should know that we shall struggle to uphold the truth as they struggle to put forth falsehood. CONTINUATION ON BOYCOTTED PRODUCTS AND WORLD CONTROVERSIAL ISSUES
Honestly, I feel at lost concerning where to begin the synopsis of the last edition of the Fiqh Forum. Undoubtedly, Ustaz Dhikrullah Shafih elucidated the topic with admirable interest as ever. Let me begin from the most interesting aspect which has the head line below.

ISLAM IS A RELIGION OF PEACE AND TRANQUILITY
In explaining this, Ustaz mentioned that there have been lots of questions that have surfaced after the last special edition of the Fiqh Forum which talked about BOYCOTTED PRODUCTS. Some of them are ..
What is going to be the fate of those working in the boycotted companies in terms of catering for their families?
What happens to the choice of the buyer if the boycotted product is the best in the market? and many more..
Ustaz Shaffiyy made it clear that the issue of boycotted products has to do with one’s level of Islamic understanding. He emphasized further saying that the major reason behind the boycott of Isreali and allies’ companies and products is because of continuous persecution, maiming, massacre of our brothers in Palestine by ISREAL with unrelenting support from America.
He restated again that Islam is a religion of peace and not at war with any religion, in spite of this, the Muslim community all over the world wants a stop to deliberate massacre of Palestinians and devastation by ISREAL since the past 62 years. It is this that calls for the peaceful way of economic boycott, which does not require carrying of weapons or ambushing anybody.
He said this is an important support we could offer as Allah as commanded us in the following verses of the Quran. “Verily, This brotherhood of yours is a single brotherhood, and I am your Lord and Cherisher: therefore Serve me( and no other).” Q21V92

He also re-affirmed that buying the products of the enemies is an act of supporting them. Allah(S.A.W) has warned us against this in Q60 Verse 8-9
“8.Allah forbids you not, with regard to those who fight you not for your faith nor drive you out of your homes, from dealing kindly and justly with them: for Allah loveth those who are just.
9. Allah only forbids you, with regard to those who fight you for your faith, and drive you out of your homes, and support others in driving you out from turning to them( for friendship and protection). It is such as turn to them(in this circumstances), that do wrong.”

NO COMPULSION IN RELIGION
As Allah has rightly commanded prophet Muhammad(S.A.W) that there is no compulsion in religion, it is mandatory for every Muslim to respect other people’s religion and never alter an obnoxious word or do anything that would obliterate their integrity. Because if Allah wills He could have made everyone a Muslim.
In line of this , he emphasize the need the world super powers should allow peace reign in the world as we are all from one parent(Adam and Eve), he quoted the following verses of the Quran.
Q49 verse 13

“O mankind! We created you from a single (pair) of a male and female, and made you into nations and tribes, that ye may know each other (not that ye may despise each other). Verily the most honoured of you in the sight of Allah is (He who is) the most righteous of you. And Allah has full knowledge and is well acquainted (with all things).




This verse denotes that we mankind are all brothers regardless of skin colour , tribes, ideology e.t.c. and we should allow peace reign and not play dual standard that could aggravate the problem of the world. Most Importantly, what makes one the best before Allah is NOT by terrorism,injustice or ambushing of ones neighbors but the most RIGHTEOUS.

MUSLIMS SHOULD BE FIRM IN UPHOLDING THE TRUTH
In addition, Muslims were implored to uphold the truth, defend it, support one another and be steadfast in their religion as there would be different measures from the enemies of Allah to thwart the efforts of the Muslims. In line with this, Ustaz quoted the verse bellow. Q2 verses 217-218


217.They ask thee concerning fighting in the prohibited month. Say: fighting therein is a grave (offence);but graver it is in the sight of Allah to prevent access to the sacred mosque, and drive out its members. Tumult and oppression are worse than slaughter. Nor will they cease fighting you until they turn you back from your faith if they can. And if any of you turn back from their faith and die in unbelief,their works will bear no fruit in life and in the Hereafter;they would be companion of the fire and will abide therein.
218. Those who believe and those who suffered exile and fought (and strove and struggle)in the path of Allah, they have the hope and the mercy of Allah: And Allah is Oft-Forgiving, Most Merciful


OSAMA BIN LADEN’S DEATH CONTROVERSY
Till today, the world is still waiting for a proof of Osama’s death from America.Also Osama Bin laden’s burial in an “awful” manner by America has raised a lot of questions among the Muslims. Ustaz Shafii mentioned that it is not allowed to burry a Muslim in the sea in Islamic jurisprudence except that there is no other option. He explained further that in a situation where someone died in a boat on a sea, that the burial should be delayed on until they get to the land area. He added that the only reason a Muslim could be buried in the sea is if there is no option of getting to the land soon and the remains could cause “disturbance” to the people, then, the Islamic rites on burial can be performed on the person, and the person can be buried in the sea. But this is contrary to the deliberate action of America in burying Osama in the sea, which scholars have seen as a great affront to Islam.

FACT ABOUT ZAMZAM WATER
Another update that took a pride of place at the last edition of the Fiqh Forum was the issue that was raised in the UK over ZAM ZAM water being able to cause cancer. Firstly, the carriers of this dilluted mentality want confuse the general public as their assertion does not have facts. They tested their so called ZAM ZAM water in their so called laboratory in order to jolt the understanding of the muslims. Saudi Government has however refuted this, saying the water has been tested many times and it has been confirmed very good for consumptions. Below are the facts about the ZAM ZAM Water.

FACTS ABOUT ZAMZAM WATER
• The water of Zamzam has great significance in Islam. Some of the facts regarding it are as follows -
• The water first sprang forth when the angel Jibreel (peace be upon him) struck (the earth) with his wing (Saheeh al-Bukhaari, 3364).
• Allah first provided this water for Ismaeel (peace be upon him) and his mother with it.
• The heart of the Prophet Muhammad (SAWS) was washed with Zamzam water.
• Many saheeh ahaadeeth have been narrated concerning its virtues, such as:
– The Prophet Muhammad (SAWS) said: “The best water on the face of the earth is the water of Zamzam; it is a kind of food and a healing from sickness.” (Saheeh al-Jaami, 3302).
– It was reported that the Prophet Muhammad (SAWS) drank it, did wudoo’ with it and poured it on his head. He used to carry Zamzam water in small vessels and large containers in order to pour it on the sick and give it to them to drink. (al-Silsilat al-Saheehah, 883).
– One of the Sahaabah said: we used to call it al-Shabbaa’ah (satisfying) and it helped us to take care our families (i.e., it was filling and helped them to do without food, it was also sufficient to nourish children). (al-Silsilat al-Saheehah li’l-Albaani, 2685).
– The Messenger of Allah Prophet Muhammad (SAWS) said: “The water of Zamzam is for whatever it is drunk for.” (Narrated by Ibn Maajah, 3062; this is a hasan hadeeth. Scholars and righteous people have experienced this – they have drunk it with the intention of fulfilling some need such as healing from sickness or being freed from poverty and distress, and Allah fulfilled these hopes).

After given thanks to Allah(Subhana Watahala) the Lord of the worlds, and seeking for the blessings of Allah on the noblest of the mankind ,Prophet Muhammad(Peace be upon him). Ustaz recapitulated the part one of the topic with admirable precisions. He then continued with the following headlines..

ISLAMIC JURISPRUDENCE ON CIRCUMCISION.

There are three opinions on circumcision in Islam, and none of these opinions negates or annuls the culture of circumcision. They are..
1. Circumcision is Compulsory on both males and females
Under this Opinion it is established strictly among some Islamic scholars that circumcision is mandatory for both males and females. This Opinion is so celebrated that a man would not be made an Imam in the mosque until it is clearly confirmed that he was circumcised. In this opinion, huge status is conferred to the issue of circumcision and barely would any post be held in Islam without putting this first even before the consideration of intellectual strengths of the individual.
2. Compulsory for males and Sunnah for females
The scholars who adhere to this opinion, make it mandatory for the males but Sunnah of Prophet Muhammad (Prophetic tradition) for females.
3. Sunnah for both males and females
The last set of scholars believe it is a prophetic tradition (Sunnah of Prophet Muhammad) on but males and females.

Despite the differences in opinions, they all point to the fact that it is an essential part of Islam, as none of them completely takes it out of Islam. Haven’t established this , it is important to know who is qualified to circumcise.

WHO IS TO CARRY OUT THE OPERATION

As coherently stated in PART 1 that circumcision is a minor operation. Islam beams very strict rules on kind of operator to carry out the opeartion, as a mistake could lead to permanent damage to the victim which Islam strictly rejects. Haven’t found a skilled and experienced operator for the operation. Some set of conditions are established .

A MALE MUSLIM DOCTOR SHOULD CIRCUMCISE THE MALE CHILD. As Islam strictly forbids being in privacy with the opposite sex that one does not have a legal rights to and who does not relate to one by blood. For this rule to be preserved, it is important to look for a muslim doctor to attend to the same sex, as this goes beyond being in privacy alone, but also involves the extremely preserved part of the body organ(the sex organ). This rule also goes for a FEMALE MUSLIM DOCTOR TO CARRY OUT THE OPEARATION FOR THE FEMALE CHILD.

If by challenges there are no male muslim doctors, the next thing is to get a non mulsim male that is trustworthy to attend to the males for the circumcision and the non muslin women that is trustworthy to attend to the muslim women. This is the rule for all medical procedures in Islam not for the circumcision alone.
If it also happens that the conditions above was posing a great challenge, then the next condition is to get a Muslim females to attend to the Muslim males and vice versa.

And if by a huge laxity in the community, those condition could not be met, then the next thing is to get a non-muslim females to attend to the Muslim males, and non-Muslim males to attend to the Muslim females, and this is the worse that could happen, we pray to Allah not to test us with this(Amin).

However, it is established again that anytime an opposite sex is to attend to a patient, it is mandatory that there must be a third person, this is necessary in order to prevent being in complete privacy with an opposite sex which Islam strictly forbids.

TIME FOR CIRCUMCISION

Ustaz Shaffiy mentioned that scholars are of different opinions on the perfect time to circumcise, but the hadith brought forth by the scholars who claim to have the proof for time for circumcision are not authentic or sound enough. Moreover some scholars believe that it is around the age of 7 years while some opine that it should be done immediately after birth so as to reduce the pain that could emanate from delayed circumcision.

THE WORLD CONSPIRACY AGAINST FEMALE CIRCUMCISION

Even after it has been proven medically that circumcision reduces the risk of genital cancer . The UN has repeatedly opposes the circumcision of the females, due to the damage caused to the females victim by amateur operators and diluted orientation.
But Interestingly, Islam is a balanced religion, it would never go beyond Allah’s prescription nor hover on its laxities. Moreover, in as much as circumcision is a prescription of Allah, Muslim would always carry out the operation properly so as not to create an horrendous scenario to the victims as stated at the beginning.

HISTORICAL BACKGROUND

Ustaz stated clearly that there are two opinions on the Origin of Circumcision in Islam. Some Scholars opine that circumcision was started by Prophet Adam(Peace be Upon him) while other Scholars are of the Opinion that it was from Prophet Ibrahim(Peace be Upon him).Ustaz quoted the evidences for the two opinions. He related the Hadith by Abu Huraira where he said Prophet narrated that Allah mandated Prophet Ibrahim to circumcise at 80years old, and he circumcised himself with a tool that looks like an axe. But in order to clear any ambiguity on the two opinions, it is generally agreed that Prophet Adam started it, but later forgotten by his pro-genies, then prophet Ibrahim re- established it through the ordinance from Allah, this can be found in Q2 Verse 124 "And remember that Ibraham was tried by his Lord with certain Commands, which he fulfilled: he said: "I would make thee an Imam to the Nations." He pleaded: "And also (Imams) from my offspring!" He answered:"But my promise is not within the reach of evildoers."


Some Historians say the origin of circumcision is popular with the Egyptians, but were known for their horrendous ways of practicing it . Also the Sudanese were known for practicing it wrongly like the Egyptians in the old days.

DIFFERENT RELIGIOUS CULTURE AND POSITIONS

Ustaz made it known that almost every race practices circumcision,even though in wrong manners. The Jews for example used to place high priority to circumcision, in fact they can go to the extent of circumcising a dead baby to prove their Judaism. circumcision is done after eight days of birth, even though it falls on the Sabat day(The day of their worship), this used to be their culture when they were still practicing the pristine religion brought by Prophet Musa(Peace be Upon him) , but this culture was soon put to an end after some time. And also the Christians placed a free will on circumcision, meaning,anybody who wishes to circumcise should go ahead and whoever does not wish should abandon it. But records show that Jesus himself was circumcised after 8 days of birth, and it was performed in the manner his people used to circumcise. Prophet Isa(Jesus)(Peace be Upon him) also placed a strong priority on circumcision and an evidence on this was pointed to the verse in the "gospel of banaba"(what is closer to the genuine "bible" brought by Jesus) Chapter 22 vs 30 31. When Jesus said that a dog is beloved to God than a person that was not circumcised. This shows how strict circumcision was during the time of Jesus. But this culture has been forgotten today.

ARABIAN CULTURE ON CIRCUMCISION BEFORE THE ADVENT OF PROPHET MUHAMMAD

One of the practices inherited by the Arabs from their great grand father(Prophet Ibrahim) was circumcision, although, not practiced the way he practiced it. Just like they inherited hajj but wrongly practiced. Arabs also inherited the culture of Islamic names from Prophet Ibrahim, like"Abdulllah", e.t.c .

But the advent of Prophet Muhammad restored the pristine culture of circumcision and other cultures inherited from prophet Ibrahim.Moreover lots of the sayings of prophet Muhammad(S.A.W) point to the fact that circumcision is a command from Allah and practices of His prophets.

Ustaz Dhikrullah Shaffiy noted that circumcision is a wide topic in Islam that is nurtured with Islamic jurisprudence. Only skilled and professional "operators" are allowed to carry it out. Islam talks on the type of people to engage in its operation, Sharia implication if it is wrongly operated by the operator is well established in Islam. In addition, one of the advantages of circumcision is that it reduces an excessive sexual urge in females. This enables them to control their emotions. This on the other hand is a perfect measure to reduce fornication, prostitution and adultery in the community. He added that there is a modern science or a medical approach on the issue of circumcision, he then added that this would be discussed coherently with no equivocalness at the next Fiqh Forum. Moreover every Muslim should have a concrete believe that circumcision is an essential part of Islam which must be established and entrenched.

The message from Palestinine(GAZA) to pray for the victims of earth-quake in Japan was also acknowledged, the prayer was done and we hope Allah(Subhana Watalah) rectifies the condition of the Japanese and those who lost lives and belongings.Audio lecture would be ready for download soon.

It was an atmosphere of joy at the Fiqh Forum yesterday(10th R.Awwal 1432), where thousands of Nigerian Muslims gathered to celebrate with their Egyptian brothers over the "step down" of Hosni Mubarak.Ustaz Dhikrullah Shaffi mentioned that the events that unfolded recently in Egypt is a true reflection of Islamic Civilization. He added that the "step down" of Hosni Mubarak as the president of Egypt would open a new gate of tranquility in the country and other Islamic states.Ustaz discussed the topic with great passion as ever, quoting copious evidences from the Qur'an,Hadith and the sayings of Scholars over Islamic understanding on "PEACEFUL DEMONSTRATIONS". He re-established that PEACEFUL DEMONSTARTION is allowed in Islam as a means to advocate for ones rights and to uphold the truth,he cited the recent Egyptian PEACEFUL demonstrations that lead to the exit of Hosni Mubarak,The Tunisians and the recent Nigerian Muslim Youths' peaceful demonstrations over wearing of HIJAB during the just concluded VOTERS REGISTRATION as examples. SPECIAL FIQH FORUM ON BOYCOTTED PRODUCTS(SOFAR 1432H, 9TH JAN. 2011)

Sheikh Dhikrullah Shafi'i established the discussion with unprecedented passion, stating that everyone should renew his intention and be sincere to the Fatwa of boycotting Israeli Products.He added that some of the products are not unlawful directly,but the Major reason that has made them HARAM(FORBIDDEN) is the fact that the companies producing them are supporting Israel in Killing the Muslims in Palestine unjustly. Also he mentioned that the money used in buying Israeli products are being converted to bullets used in killing the Muslims especially children and women in Palestine. It is on these, that the world Islamic scholars have placed a FATWA to boycott Israeli products and the companies supporting them,and this boycott shall remains until the killings in GAZA is stopped and and Palestinian nation is fully given back to them.Moreover, Palestinian land houses the third most sacred mosque(Mosjidil Aqsah) mentioned to us by Prophet Muhammad(Peace Be Upon Him), and of course the sacred Mosjidil Qudus.These goes along way to tell us that Palestine is an Important Nation to the Muslim Ummah and we must do everything to protect and support her.Prophet Muhammad(Peace be upon him said "All muslims are like a body, that if a part is injured the whole body feels the pain".This implies that one of the ways we can share from the agonies our brothers and sisters are going through in Palestine is to completely BOYCOTT Israeli products. All these he discussed with copious evidences from Qur'an, Hadith and the Fatwa of Scholars.Sheikh also condemned the recent bombing in JOS, Nigeria, stating clearly that , Islam is a religion of peace and has nothing to do with terrorism,violence or any act that could harm humans.He then called on the authority in the state to check themselves and get the perpetrators apprehended. The next Fiqh Forum which shall come up Insha Allah on Sun.,13th of February shall also be a special one as Questions that arises from the issue of boycott would be made clear without ambiguity.The Lecture shall be made available on this site as soon as they are ready.
